PLEASE READ THIS POLICY CAREFULLY BEFORE USING OUR PLATFORM.

1. Purpose and Scope

This Acceptable Use Policy applies to all activity on raffclub.com and any related mobile application or digital service operated by RaffClub Limited (the Platform). It applies to all users, including Organisations, Promoters, Entrants, account holders, guest users and website visitors.

This policy applies to uploading, posting, creating or sharing material ("User Content"), creating or administering Promotions, providing Promotion or Prize information, interacting with other users, and linking to or from our Platform.

You must comply with this policy in both letter and spirit. RaffClub Limited may determine, acting reasonably, whether use of the Platform or content made available through it breaches this policy.

This policy should be read together with our Platform Terms of Use and, where applicable, the RaffClub Terms of Service and the terms and conditions applying to an individual Promotion.

2. General Conduct Requirements

You must use our Platform lawfully, ethically and responsibly. In particular, you must:

• comply with all applicable laws and regulations;
• respect the rights, privacy and intellectual property rights of others;
• provide information that is accurate and not deliberately misleading;
• not misuse, harm, interfere with or disrupt the Platform, its functionality or its users;
• not use the Platform for fraud, financial crime, unlawful gambling or other illegal activity; and
• comply with any reasonable instructions issued by RaffClub concerning Platform security, compliance or acceptable use.

3. Standards Applicable to Promotions and Prizes

Where an Organisation creates, administers or promotes a raffle, Prize Draw or other fundraising promotion through the Platform (a Promotion), the Organisation is the Promoter and must ensure that:

• it has the legal right, authority and capacity to operate the Promotion;
• the Promotion is lawful and complies with all applicable legal and regulatory requirements;
• all licences, registrations, permissions or approvals required for the Promotion have been obtained and remain valid;
• all Promotion information, rules, advertising and fundraising statements are accurate, clear and not misleading;
• eligibility requirements, including applicable age and geographical restrictions, are accurately stated;
• the Prize exists, is available as represented and may lawfully be offered;
• the Organisation has the legal right and practical ability to provide, transfer, deliver or otherwise fulfil the Prize;
• the Prize is accurately described and any stated value is not misleading;
• the Organisation can fulfil the Prize in accordance with the applicable Promotion terms; and
• any statements concerning the fundraising purpose, beneficiary, use of proceeds or charitable impact are accurate.

RaffClub may refuse to activate, suspend or remove a Promotion where it reasonably believes that these standards have not been met.

4. Prohibited Prizes and Promotions

You must not create, advertise, administer or facilitate a Promotion involving a Prize, activity or arrangement that is unlawful, misleading, unsafe, inappropriate for the Platform or prohibited by RaffClub.

Without limitation, the following must not be offered as Prizes through the Platform unless RaffClub has expressly approved them in writing and their use is lawful:

• cigarettes, tobacco products, e-cigarettes, related refill products or prescription-only medicines;
• alcoholic drinks;
• weapons, explosives or similar restricted items;
• controlled drugs or substances, or paraphernalia related to illegal drug use;
• counterfeit, stolen, recalled, expired, unsafe or defective goods;
• items or content that infringe third-party intellectual property rights; or
• items, services or experiences that promote violence, discrimination, exploitation or illegal activity.

RaffClub reserves the right to refuse, restrict, suspend or remove a Promotion or Prize that does not comply with this policy or which RaffClub reasonably considers inappropriate for the Platform.

5. Guaranteed Prizes (If Applicable)

An Organisation must not describe or advertise a Prize as guaranteed unless it has sufficient financial resources, rights and arrangements to provide that Prize in full regardless of the number of Entries sold or the amount raised by the Promotion.

An Organisation must not state or imply that RaffClub funds, guarantees, underwrites or will make good any shortfall in a guaranteed Prize unless RaffClub has expressly agreed to do so in writing.

The Organisation remains responsible for honouring any guaranteed Prize in accordance with the applicable Promotion terms and the RaffClub Terms of Service.

6. Fundraising, Charity and Organisation Misuse

You must not use the Platform to mislead Entrants or other users about an Organisation, a fundraising purpose, a beneficiary or the use of funds.

In particular, you must not:

• falsely claim to be a registered charity, not-for-profit organisation or other eligible Organisation;
• falsely claim to represent, be affiliated with, be endorsed by or raise funds for another person or Organisation;
• impersonate a charity, trustee, director, employee, volunteer, authorised representative or other person;
• create a false or misleading fundraising campaign or Promotion;
• misrepresent how funds raised through a Promotion will be used;
• make false or misleading statements about the amount or proportion of proceeds that will benefit a cause or beneficiary;
• divert, misappropriate or attempt to misuse charitable or fundraising proceeds; or
• provide false, forged or misleading verification, licensing, registration or Organisation information.

7. Prohibited Conduct

You may not use our Platform for:

• uploading or sharing material that is unlawful, fraudulent, obscene, defamatory, hateful or unlawfully discriminatory;
• engaging in or promoting illegal activities, including terrorism, money laundering, financial fraud, human trafficking or other criminal activity;
• bullying, insulting, intimidating, humiliating, harassing or threatening others;
• invading another person's privacy or unlawfully disclosing personal information;
• sending unsolicited advertising, promotional material, spam or other unauthorised communications;
• uploading unrelated advertising material or external promotional links without appropriate permission;
• knowingly transmitting viruses, spyware, malware or other harmful software;
• attempting unauthorised access to systems, accounts or data;
• interfering with the normal operation, security or integrity of the Platform; or
• using the Platform in a way intended to circumvent applicable terms, controls, restrictions or safeguards.

8. Promotion Manipulation and Platform Abuse

You must not manipulate, attempt to manipulate or interfere with a Promotion, Entry process, winner-selection process or any related Platform functionality.

Without limitation, you must not:

• create fraudulent or artificial Entries;
• use multiple accounts, identities or other methods to circumvent Entry limits, eligibility requirements or restrictions;
• collude with another person to manipulate or improperly influence a Promotion or its outcome;
• interfere with or attempt to manipulate winner-selection or draw technology;
• exploit bugs, errors, vulnerabilities or unintended Platform functionality;
• manipulate, reverse, evade or improperly interfere with payment processes;
• use automated tools or scripts to obtain an unfair advantage in a Promotion; or
• attempt to access or alter data relating to Entries, Promotions, users or Platform systems without authorisation.

Text and data mining, web scraping and use of Platform content or data for developing, training, fine-tuning or validating AI systems or models are governed by the Platform Terms of Use and are prohibited except to the extent expressly permitted by RaffClub or applicable law.

9. Standards for User and Organisation Content

User Content and Organisation Content, including Promotion descriptions, Prize descriptions, images, logos, charity information, fundraising statements and other materials uploaded, posted or shared through the Platform, must:

• be accurate where stating facts and genuinely held where stating opinions;
• comply with applicable law and not infringe third-party rights;
• not be defamatory, obscene, offensive, hateful, inflammatory, pornographic or unlawfully discriminatory;
• not promote illegal, unsafe or harmful behaviour, including self-harm, suicide, eating disorders or dangerous acts;
• not deliberately mislead users about a Promotion, Prize, Organisation, beneficiary or fundraising purpose;
• not misrepresent your identity or association with any person or Organisation; and
• not contain malicious code, hidden functionality or material designed to compromise the Platform or another user.

You warrant that you have all necessary rights, licences, permissions and consents to upload, post or share any content made available by you through the Platform.

10. Illegal and Harmful Content

RaffClub will cooperate with law enforcement, regulators and other competent authorities where required or permitted by law in relation to suspected illegal activity occurring on or through the Platform.

The following are strictly prohibited and may be reported to the relevant authorities where required:

• fraud, financial crime, or the creation, distribution or promotion of counterfeit, stolen or unauthorised goods;
• terrorism, child sexual exploitation, human trafficking or exploitation of any kind;
• unlawful discrimination or harassment;
• promotion or sale of controlled substances or illegal weapons; and
• content inciting hatred or making explicit threats of, or encouraging, violence against any person, group or animal.

11. Very Sensitive or Harmful Material

You must not post, share, upload or create material which is:

• grossly offensive, indecent, obscene or intended to cause serious distress, anxiety or fear;
• knowingly false and intended to cause significant harm;
• threatening death or serious harm;
• designed or likely to cause harm to individuals with photosensitive epilepsy or to encourage self-harm;
• bullying, humiliating or persistently harassing; or
• an unsolicited sexual image or sexually explicit manipulated or synthetic image, including a sexually explicit deepfake.

12. Advertising and Promotion

Organisations may use functionality provided by RaffClub to create, display and promote their legitimate Promotions and fundraising activities, subject to this policy, the Platform Terms of Use, the RaffClub Terms of Service and applicable law.

You must not use the Platform for unrelated third-party advertising, affiliate marketing, spam, unauthorised commercial promotion or promotion of external services or websites without RaffClub's prior permission.

All advertising and promotional material relating to a Promotion must be accurate, not misleading and consistent with the applicable Promotion terms.

13. Consequences of Breach

If RaffClub reasonably believes that you have breached this policy, we may take one or more of the following actions, depending on the nature and seriousness of the breach:

• issue a warning or require corrective action;
• remove, disable or restrict access to offending content;
• refuse to activate a Promotion;
• suspend, restrict or remove a Promotion;
• prevent or restrict further Entries where appropriate;
• temporarily or permanently suspend, restrict or terminate an account or access to the Platform;
• restrict particular Platform functionality;
• take action under the Platform Terms of Use, RaffClub Terms of Service or applicable Promotion terms;
• report suspected unlawful activity to law enforcement, regulators, payment providers or other competent authorities where appropriate or required; and/or
• take legal action.

Where practicable and appropriate, RaffClub may give the affected user or Organisation an opportunity to remedy a breach. RaffClub may act immediately where necessary to protect users, the Platform, a Promotion, a beneficiary, RaffClub or third parties, or to comply with legal or regulatory obligations.

14. Changes to this Acceptable Use Policy

We may update this policy from time to time. We will notify users of material changes by publishing an updated policy on our Platform and, where appropriate, by email or another reasonable method.

Continuing to use the Platform after an updated policy takes effect constitutes acceptance of the updated policy to the extent permitted by applicable law.
