Purpose and Scope
This policy applies to all activity on our Platform, including uploading, posting, creating, or sharing material ("User Content"), interacting with other users, creating listings, and linking to or from our Platform.
You must comply with this policy in both letter and spirit.
RaffClub Limited may, at its sole discretion, determine whether any use or content breaches this policy.
General Conduct Requirements
You must use our Platform lawfully, ethically and responsibly. In particular, you must:
- Comply with all applicable laws and regulations (including those of England and Wales);
- Respect the rights, privacy, and intellectual property of others; and
- Not harm, interfere with, or disrupt the Platform, its functionality, or its users.
Standards Applicable to Listings
When creating a listing on our Platform, you must ensure that:
- You have the legal right and necessary authority to offer and transfer the item or experience to the winner;
- The item or experience is accurately described and available as stated at the time of the prize draw; and
- No item or experience is misleadingly described or falsely represented.
You must not create a listing in respect of an item or experience that is:
- Illegal or prohibited under the laws of England and Wales or any other applicable law;
- Offensive, obscene, dangerous, or otherwise inappropriate for our Platform; or
- Recalled, expired, counterfeit, or defective.
In particular, the following items are strictly prohibited from being listed on our Platform:
- Cigarettes, tobacco products, e-cigarettes or related refill containers, or prescription-only medicines;
- Alcoholic drinks;
- Weapons, explosives, or any similar restricted items;
- Controlled drugs or substances, or any paraphernalia related to drug use;
- Items that infringe third-party intellectual property rights; and
- Items or experiences that promote violence, discrimination, or illegal activity.
RaffClub Limited reserves the right to remove or refuse any listing that does not comply with this policy, or the spirit of this policy, at any time and without prior notice.
Prohibited Conduct
You may not use our Platform for:
- Uploading or sharing any material that is unlawful, fraudulent, obscene, defamatory, hateful, or discriminatory;
- Engaging or promoting illegal activities, including but not limited to terrorism, money laundering, financial fraud, human trafficking or other criminal activity;
- Bullying, insulting, intimidating, or humiliating others;
- Uploading or sharing any content that harasses, threatens, or invades another's privacy;
- Sending unsolicited advertising, promotional material, or spam;
- Uploading advertising material or links without appropriate permission;
- Knowingly transmitting viruses, spyware, or other harmful software; or
- Interfering with the normal operation of our Platform or attempting unauthorised access to systems or data.
Standards for User Content
User Content must:
- Be accurate (where stating facts) and genuinely held (where stating opinions);
- Comply with all applicable laws and not infringe any third-party rights;
- Not be defamatory, obscene, offensive, hateful, inflammatory, pornographic, or violent;
- Not promote illegal, unsafe, or harmful behaviour, including self-harm, suicide, eating disorders, or dangerous acts; and
- Not misrepresent your identity or your association with any person or organisation.
You warrant that you have all necessary rights and permissions to upload, post, or share any User Content.
Illegal and Harmful Content
RaffClub Limited will cooperate with law enforcement and regulatory authorities when required to investigate and report suspected illegal activity occurring on or through our Platform.
The following are strictly prohibited and will be reported to the relevant authorities where required:
- Creation or distribution of counterfeit, stolen or unauthorised goods, fraud, or other financial crime;
- Terrorism, child sexual exploitation, trafficking of any kind;
- Discrimination under the Equality Act 2010 (including race, religion, sex, disability, sexual orientation or gender reassignment);
- Promotion or sale of controlled substances or illegal weapons; and/or
- Content inciting hatred or explicit threats/encouragement of violence against any person, group, or animal.
If you become aware of any illegal content on our Platform, please notify us immediately at enquiries@raffclub.com.
Very Sensitive or Harmful Material
You must not post, share, or create material which is:
- Grossly offensive, indecent, obscene or intended to cause distress, anxiety, or fear;
- Knowingly false and intended to cause significant harm;
- Threatening death or serious harm;
- Likely to cause harm to individuals with epilepsy or encourage self-harm;
- Bullying, humiliating, or persistently harassing;
- Any unsolicited sexual images or sexually explicit "deepfakes".
Advertising
No advertising or promotion of external services or websites may be shared on our Platform without our prior written consent.
Consequences of Breach
A breach of this policy may result in:
- Immediate, temporary, or permanent suspension or termination of your account;
- Removal of any offending content;
- Issuing a warning to you;
- Reporting you to law enforcement or other relevant authorities; and/or
- Legal action.
Changes to this Acceptable Use Policy
We may update this policy from time to time. We will notify users of material changes either by publishing an updated policy on our Platform or via email. Continuing to use our Platform following such notification constitutes acceptance of the changes.
